Apply for remission of daily fines for beneficial owners

Remissions are only granted in exceptional cases.
Organisations that have had daily fines imposed after being notified of possible errors in the register, and did not submit an updated form by the deadline, may apply for a remission.
You cannot apply for a refund if the fines relate to not completing the initial registration of beneficial owners
When can an organisation apply for a remission?
The organisation can apply for a remission once the daily fines have stopped and been set.
To stop the fines, you must submit the form Register beneficial owners in Altinn.
The daily fines will also stop if the organisation:
- is struck off after submitting the Coordinated register notification in Altinn
- file for bankruptcy with the district cour
- for NUF – is struck off the Register of Business Enterprises, apply to organisations who are not required to be registered in the Register of Business Enterprises
- is undergoing compulsory dissolution or liquidation
The organisation must pay the daily fines even if it applies for a remission. If the application is approved, the amount will be refunded in full or in part.
The application must be submitted within one year of receiving the notice of daily fines (varsel om dagbøter) in Altinn.
What must the application include?
You must submit a written application that:
- explains why the organisation did not submit an updated form on beneficial owners by the deadline
- includes documentation supporting your explanation
Conditions for a remission
The conditions for a remission of the daily fines are:
For the remission to be granted, the applicant must:
- document that unexpected circumstances arose that were beyond their control in their role as responsible for the organisation
- show that you took all possible steps to meet the submission requirement
There must be a clear connection between what happened and why the form was not submitted on time.
The condition applies when maintaining the daily fines would be entirely unreasonable. This occurs only in highly exceptional circumstances.
The terms are strict and it is difficult to be remitted the daily fines. We can only remit the fines in whole or part in extraneous circumstances.
- acute or severe illness
- data casualty
- fire
- theft
- ignorance of laws and rules that apply
- age
- illness affecting only one individual when there are several individuals with roles in the organisation
- when the board post is a formality
- has not received a reminder to submit the form
- little or no activity in the organisation
- that the organisation is under liquidation
- that the enterprise has a charitable purpose, is run by voluntary work or does not conduct business activities
- misunderstandings and other internal affairs between the organisation and its accountants or auditors, or other who works with identification of the beneficial owners on behalf of the organisation
- poor economy in the organisation
- that the daily fines are unreasonably large
- high workload
- technical issues with internal systems at the organisation
